**CANCELLATION AND REFUND RULES**
**Cyprus Taxi TRANSFER CANCELLATION AND REFUND**
**CAR RENTAL WITH DRIVER AND SERVICE AGREEMENT**
**Parties**
The parties to this “Agreement” are Cyprus Taxi, located at Ramadan Cemil Square, GİRNE / CYPRUS Turkey (hereinafter referred to as Cyprus Taxi Transfer), and the person who purchases the service by providing the necessary information in the online area named cyprustaksi.com (hereinafter referred to as the Buyer).
Cyprus Taxi Transfer and the Buyer will be individually referred to as “Party” and collectively as “Parties.”
**Subject and Service Information:**
Cyprus Taxi Transfer agrees to provide the service specified in this agreement (“Car Rental with Driver Service”) under the terms of this Agreement, and the Buyer agrees to purchase the Service at the price detailed in the agreement and pay Cyprus Taxi Transfer. The Parties mutually agree to the terms and conditions outlined below as a result of the mutual declarations and commitments given under this Agreement.
The Car Rental with Driver Service refers to the rental of vehicles (detailed with photos) along with a driver on the website cyprustaksi.com, to transfer the Buyer “from one address (point) within the borders of the Republic of Turkey to another address (point)” (hereinafter referred to as the transfer).
**Service Fee and Payment**
The service fee varies depending on the type of service detailed on cyprustaksi.com. However, the service fee depends on the type of service and the selected vehicle as specified on cyprustaksi.com. Even if fewer people than the vehicle’s maximum capacity board the vehicle, the service fee remains unchanged. For instance, in a vehicle with a capacity of six people (excluding the driver), whether the Buyer purchases the service for one or six people, the fee will remain the same.
Information regarding the reservation and the selected service type will be sent via SMS to the phone number provided by the Buyer and/or via email to the email address provided by the Buyer. Cyprus Taxi Transfer is not responsible for incorrect or inactive phone numbers or email addresses provided by the Buyer.
**Rights and Obligations of the Parties**
The Buyer agrees and undertakes that all information, including identity, contact, and address information provided to Cyprus Taxi Transfer under this Agreement, is accurate. The Parties acknowledge that Cyprus Taxi Transfer will not be held liable if it cannot fulfill its contractual obligations due to incorrect information provided by the Buyer. Furthermore, if Cyprus Taxi Transfer suffers any direct or indirect damage as a result of the incorrect information, the Buyer agrees to compensate Cyprus Taxi Transfer for such damages in full and immediately.
Cyprus Taxi Transfer has taken the necessary precautions to ensure the security of the information and transactions entered by the Buyer on the cyprustaksi.com platform to the best of modern technical capabilities. However, since the information is entered on the Buyer’s device, the Buyer is responsible for taking necessary precautions, including those related to viruses and other harmful software, to protect the information from unauthorized access.
The payment method is by cash, bank transfer/EFT, or credit card. The Buyer may pay the service fee via cash, bank transfer/EFT, or credit card. If the Buyer fails to pay the service fee in full to Cyprus Taxi Transfer, Cyprus Taxi Transfer reserves the right to unilaterally terminate the Agreement and not provide the Service.
If the Buyer pays the service fee by credit card and the bank charges additional fees, Cyprus Taxi Transfer is not responsible for such fees, and the Buyer should contact their bank for any disputes.
If the Buyer chooses to pay via bank transfer/EFT and the bank charges an EFT fee, the Buyer is responsible for this fee. Cyprus Taxi Transfer cannot deduct this fee from the service fee.
The Buyer is required to provide information about the type of vehicle requested for the service, the number of passengers, the total number of luggage pieces, the size and weight of the luggage, and any special conditions related to passengers when requesting the service. The Buyer cannot request more passengers or luggage than specified for the chosen vehicle. If Cyprus Taxi Transfer refuses to accommodate passengers or luggage exceeding the vehicle’s capacity, this does not constitute a valid reason for contract termination by the Buyer, and the Buyer remains obligated to pay the full service fee.
The details provided by the Buyer regarding passengers and luggage cannot be changed unless accepted by Cyprus Taxi Transfer. If Cyprus Taxi Transfer does not accept the change request, this does not provide a valid reason for the Buyer to terminate the Agreement. If the Buyer chooses not to receive the service in this case, they are still obligated to pay the service fee, and if they have already paid, no refund will be given.
The Buyer is required to notify Cyprus Taxi Transfer no later than 4 hours before the reservation if any of the passengers require a wheelchair due to a disability. If any passengers have medical conditions, they must provide documents proving that they do not have contagious diseases and are fit to travel. Otherwise, the Buyer will be responsible for any damages incurred by Cyprus Taxi Transfer.
Passengers must comply with the laws of the Republic of Turkey during the transfer. Passengers are required to wear seat belts, and alcohol consumption in the vehicle is prohibited. They cannot carry illegal items, drugs, or any goods prohibited by Turkish law. If Cyprus Taxi Transfer detects suspicious behavior, it reserves the right to refuse service and notify the authorities. In such cases, Cyprus Taxi Transfer is entitled to the full service fee, and the Buyer is responsible for any damages caused to Cyprus Taxi Transfer and other passengers.
The Buyer must make a reservation at least 2 hours before the transfer time to receive the service under this Agreement. For services on national holidays or public holidays in Turkey, such as Ramadan and Eid al-Adha, and on days of special importance (July 15, May 1, January 1, April 23, May 19, August 30), the Buyer must make a reservation at least 24 hours in advance.
The Buyer can exercise their right to cancel by notifying Cyprus Taxi Transfer in writing, via email at info@cyprustaksi.com, by SMS, or via WhatsApp at +90 533 888 64 28 at least 1 hour before the scheduled transfer. If the cancellation is not made within the specified time frame, Cyprus Taxi Transfer retains all its legal rights. If the Buyer exercises the right of cancellation in time, Cyprus Taxi Transfer will refund the service fee if already paid. Refunds are governed by Article 5 and subsequent clauses of this Agreement. If the Buyer cancels outside the specified time frame, the service fee will not be refunded.
The Buyer cannot change the transfer route after the Agreement has been concluded. The Buyer cannot request stops at additional addresses or waiting at any address. Cyprus Taxi Transfer reserves the right to provide additional services for a fee if requested by the Buyer.
Cyprus Taxi Transfer is obligated to comply with regulations and take necessary precautions to ensure safe service. This includes ensuring periodic maintenance, providing first aid kits, and securing individual accident and seat insurance for the vehicles used for the service.
